To formation of apartment owners association under the West Bengal Apartment Ownership Act, 1972, there are four important steps that are required to be followed:

(1) Online Submission of Application for Formation of Apartment Owners Association,

(2) Providing property details in online fill up of Form A by the apartment owners (all or majority of the owners) in online,

(3) Offline Submission of Form A with Annexure A to E, and

(4) Submission of Form 1 with relevant documents for registration of the Apartment Association.

To form and register an Association, the process must be completed in both online and offline phases, as detailed below.

ONLINE PROCESS

Step 1: Online Application for Registration of Association of Apartment Owners  

Prospective applicants should first visit the official portal at [https://edistrict.wb.gov.in/portal/home] and create an account. Once logged in, the user will encounter a tab called “Services” and in “Service” Tab, there is a service title called “Department”, under this section select “Housing”, where the user will find the option for “Registration of Association of Apartment Owners”.

Upon selecting this option, the following information will be displayed for submitting Form A:

A. Eligibility Criteria

1. Sole, majority or all the apartment owners should owners should apply for the service

B. Required Documents

1. Authenticated copy (Duly signed by declarants and Notary) of the building plan/ plans.

2. Authenticated copy (Duly signed by declarants and Notary) of the site plan.

3. Copy of relevant Completion certificate from the local authority/ Municipality duly notarized.

4. Self-attested EPIC Card (Elector’s/Voter’s Photo Identity Card)/PAN card of all the Apartment Owners.

5. Power of Attorney as per format, where necessary of all the apartment owners or concerned apartment owners. (Download the sample format)

6. Copy of Receipt of Form-E, sent through hand, post or email. (Download the sample format)

7. Document containing all the owners’ details and common portions of the building (Excel templates for inserting owners’ details and share of common portions). (Download the sample formats Excel 1, Excel 2 & Excel 3 )

8. Authorization letter by all the other flat owners. (Download the sample format).

C. Fee Structure

Step 2: Online Submission of Documents

Once Form A has been completed, the applicant must upload the required documents and convert the filled Excel form into a PDF for uploading. Step 3: Approval Process of the Online Application

Upon submission, the Competent Authority will review the application within the system. If everything is in order, the application will be approved, and an automated notification will be sent to the applicant’s registered mobile number and email. The applicant will also receive instructions to submit hard copy of Form A to the office of the Competent Authority at Housing Department, Law and Apartment Cell, 1st Floor of New Secretariat Building, 1, Kiran Shankar Roy Road, Kolkata – 700001.

Should any discrepancies be noted during the review process, the system will notify the applicant in real-time with the necessary corrections, which must be addressed accordingly.

By following these steps, forming and registering an Apartment Owners Association under the West Bengal Apartment Ownership Act, 1972 in online can be completed properly which was previously more complicated.

After the filing of online Form A, the declarants have to submit hard copy of Form A to the office of the Competent Authority at Housing Department, Law and Apartment Cell, 1st Floor of New Secretariat Building, 1, Kiran Shankar Roy Road, Kolkata – 700001.
